The Culture and Sensitivity Report Is Your Roadmap to Liability
Every culture and sensitivity report (C&S) tells you three critical things: what bacteria grew, which antibiotics kill it, and which antibiotics do nothing. The report uses three categories. Sensitive (S) means the antibiotic works against the organism. Intermediate (I) means the drug works only at higher doses or in specific body sites. Resistant (R) means the antibiotic fails to kill the bacteria. When a patient receives an antibiotic marked resistant while their infection worsens, you have documentation of deviation from standard of care.
Timing Separates Negligence from Acceptable Practice
Most C&S reports take 48 to 72 hours from specimen collection to final results. Preliminary reports arrive within 24 hours showing what organism is growing. Final reports include full sensitivity panels. Your timeline analysis starts with the collection date and time stamped on the lab requisition. Track when preliminary results posted to the chart. Track when final results posted. Then track when the provider reviewed the results and when they changed the antibiotic. A five-day delay between final C&S results showing resistance and antibiotic modification is indefensible. I have seen delays of seven to ten days while patients deteriorated into septic shock.
Empiric Therapy Must Match Clinical Guidelines
Providers start empiric antibiotics before C&S results return. This is standard practice. The antibiotic choice must match published guidelines for the suspected infection source. Urinary tract infections get different empiric coverage than pneumonia or cellulitis. The medical record must document the suspected source and reasoning behind the initial antibiotic choice. When the empiric antibiotic misses common organisms for the suspected site, you have your first deviation. A patient with suspected hospital-acquired pneumonia who receives only a narrow-spectrum oral antibiotic demonstrates poor clinical judgment before the culture even results.
Minimum Inhibitory Concentration Numbers Tell the Dosing Story
The C&S report lists MIC values next to each antibiotic. MIC stands for minimum inhibitory concentration, the lowest drug concentration needed to stop bacterial growth. Lower MIC numbers mean the antibiotic works better. An MIC of 0.5 is more effective than an MIC of 16 for the same drug. The breakpoint determines whether the lab reports sensitive, intermediate, or resistant. These breakpoints assume the provider uses standard dosing. When an antibiotic shows intermediate sensitivity, higher doses or longer infusion times sometimes overcome resistance. The medical record must show the provider adjusted dosing accordingly. I reviewed a case where gentamicin showed intermediate sensitivity with an MIC of 8. Standard dosing failed. The provider never increased the dose or checked trough levels. The patient developed endocarditis.
Multi-Drug Resistant Organisms Require Infectious Disease Consultation
When C&S reports show resistance to three or more antibiotic classes, the organism qualifies as multi-drug resistant (MDR). MRSA, VRE, ESBL-producing bacteria, and CRE all fall into this category. Standard of care requires infectious disease consultation for MDR infections. The consult must happen within 24 hours of MDR organism identification in critically ill patients. Look for the consultation note in the medical record. Look for documentation the primary team followed ID recommendations. When no ID consultation appears despite MDR organisms and clinical deterioration, liability exposure increases. The defense will struggle to explain why they managed a complex resistant infection without specialist input.
Source Control Failure Turns Treatable Infections Fatal
Antibiotics alone do not cure every infection. Abscesses need drainage. Infected hardware needs removal. Necrotic tissue needs debridement. The C&S report identifies the organism and guides antibiotic selection, but source control determines survival. I worked a case where C&S showed sensitive organisms and the patient received appropriate antibiotics within hours. The patient died anyway. The infected gallbladder was never removed. The medical record must document source control evaluation and intervention. Imaging reports showing undrained fluid collections while the patient receives weeks of antibiotics demonstrate incomplete treatment. The infection never clears because the source remains.
Repeat Cultures After Treatment Failure Are Mandatory
When fever persists or infection markers rise despite 48 to 72 hours of targeted antibiotic therapy, the provider must obtain repeat cultures. Bacterial resistance develops during treatment. New organisms emerge. The original C&S no longer applies. Failure to obtain repeat cultures when the patient is not improving constitutes substandard care. I see this pattern repeatedly in nursing home cases. The patient receives 14 days of antibiotics based on one culture while remaining febrile and confused. No one rechecks. The antibiotic-resistant organism grows unchecked. By the time the patient reaches the hospital, they are septic.
