The defense will argue the patient was immunocompromised or stressed from surgery. You counter with the differential count. Neutrophils above 70% with bandemia (immature neutrophils above 10%) confirms acute bacterial infection, not stress response.
Procalcitonin Separates Bacterial Infection from Everything Else
ProCalcitonin (PCT) rises only in bacterial infections. Viral infections, autoimmune conditions, and post-surgical inflammation do not elevate it. Normal PCT stays below 0.05 ng/mL. I flag cases where lactate stayed elevated or rose despite fluid resuscitation. A lactate of 4.2 at hour zero and 4.8 at hour six proves inadequate resuscitation. The Surviving Sepsis Campaign guidelines require lactate remeasurement within six hours if initial value exceeds 2.0. Missing that follow-up lactate is a documentation failure worth examining.
Blood Culture Timing Proves or Destroys Your Causation
Blood cultures taken before antibiotics identify the organism and source. Cultures drawn after antibiotics administration often come back negative or show contaminants. I see hospitals skip cultures and start broad-spectrum antibiotics blindly. This destroys your ability to prove the infection source. You need cultures drawn from two separate sites within 45 minutes of sepsis recognition. Positive cultures from a central line tip and blood sample prove central line-associated bloodstream infection (CLABSI). Positive cultures growing E. coli or Pseudomonas with matching antibiograms from urine and blood prove the UTI caused the sepsis. The microbiology report timestamps everything. Use it.
C-Reactive Protein and ESR Track Inflammation Trends
CRP rises within six hours of infection or inflammation. ESR rises more slowly over days. Normal CRP stays below 10 mg/L. Infection pushes it above 50 mg/L. I use CRP trends to show worsening infection despite treatment. A CRP of 45 on day one, 120 on day three, and 200 on day five demonstrates failed source control or wrong antibiotic choice. ESR matters less in acute cases but supports chronic infection claims. An ESR above 100 mm/hr suggests abscess, osteomyelitis, or endocarditis. Combine elevated ESR with positive blood cultures and imaging findings to prove the infection was brewing before admission or developed during hospitalization.
The Sequential Organ Failure Assessment Score Quantifies Negligence
SOFA score uses six objective measures: respiratory function (PaO2/FiO2 ratio), coagulation (platelet count), liver function (bilirubin), cardiovascular status (mean arterial pressure and vasopressor need), neurological status (Glasgow Coma Scale), and renal function (creatinine and urine output).
